Subscriber/User refers to people who visit the website and use the website.  Throughout the agreement, these terms apply to any person/persons or any entity that uses the website.

The Money Savers Network Inc. hereby makes no representation or warranty of any kind, express or implied, as to the quality of the Service Providers or the exactness of any information The Money Savers Network Inc. provides to Subscriber/User.  Subscriber/User expressly agrees that any use of information provided by The Money Savers Network Inc. is for the Subscriber's/User's personal use and that such information will be acted on by Subscriber, at Subscriber's sole risk.  Subscriber/User waives the right to file suit against The Money Savers Network Inc. or its owners, agents, officers, and employees.

Limitations of Liability Part 1

Limitations of Liability Part 2 and Release

The Money Savers Network Inc. will not be liable for damages of any nature arising from or relating to Subscriber's/User's use of the service offered by The Money Savers Network Inc. or the use thereof by anyone else or Subscriber's/User's use of any services provided by the Service Provides or for any work performed by the Service Providers.  The Money Savers Network Inc.'s total cumulative liability to Subscriber/User and anyone who uses the service or the Service Provider's services through Subscriber's/User's account, for any and all claims under any theory of law (including negligence), will not exceed $1.00. 

Subscriber/User agrees not to hold The Money Savers Network Inc. responsible for any damages or other liabilities arising from work performed by any Service Provider.  The Money Savers Network Inc. is not, cannot and will not be involved in Subscriber's/User's dealings with the Service Providers or control whether or not Service Providers complete any work as agreed, in the event that Subscriber/User has a dispute with one or more Service Providers, Subscriber/User releases The Money Savers Network Inc. (and its agents, officers and employees) from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Proprietary Information

The Information is the property of The Money Savers Network Inc. and you agree not to reproduce, retransmit, disseminate, sell, distribute, publish, broadcast, circulate or commercially exploit the Information in any manner without the express written consent of The Money Savers Network. You also agree not to use the Information for any unlawful purpose.

These Terms are governed and interpreted pursuant to the laws of the State of Michigan, United States of America, notwithstanding any principles of conflicts of law. All disputes arising out of or relating to these Terms shall be finally resolved by arbitration conducted in the English language in Lansing, Michigan, U.S.A. under the commercial arbitration rules of the American Arbitration Association. The parties shall appoint as sole arbitrator a retired judge who presided in the State of Michigan. The parties shall bear equally the cost of the arbitration (except that the prevailing party shall be entitled to an award of reasonable attorneys' fees incurred in connection with the arbitration in such an amount as may be determined by the arbitrator). All decisions of the arbitrator shall be final and binding on both parties and enforceable in any court of competent jurisdiction. Notwithstanding this, application may be made to any court for a judicial acceptance of the award or order of enforcement. Notwithstanding the foregoing, The Money Savers Network Inc. shall be entitled to seek injunctive relief, security, or other equitable remedies from the United States District Court for the Western District of Michigan or any other court of competent jurisdiction. If any part of these terms is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of the remaining provisions. The Money Savers Network Inc. may, at their sole discretion and without notice, revise these terms at any time by updating this posting.

ENTIRE AGREEMENT 

This is the entire Agreement between the parties relating to the subject matter herein and shall not be modified except in writing signed by both parties or by a new posting by The Money Savers Network website, as described above.

GENERAL

By using the service offered by The Money Savers Network Inc., Subscriber/User acknowledges that The Money Savers Network Inc. is not acting as Subscriber's/User's general contractor, agent, or advisor.  Therefore, it is Subscriber's/User's sole responsibility to select a Service Provider and to negotiate the terms for any work to be performed by the Service Provider.  Subscriber/User may want to consult with appropriate expert advisors to assist Subscriber/User, including but not limited to, a financial advisor regarding investment decisions, a lawyer regarding contracts, permits, and other matters and documents, and an insurance professional regarding the Service Provider's and Subscriber's own insurance coverage requirements.

The Money Savers Network Inc. does not a) endorse any specific Service Provider; b) provide advice on which Service Provider to select; or c) warrant any of the work a Service Provider may provide to Subscriber/User.

The Money Savers Network Inc. does not guarantee or warrant the qualifications of any Service Provider who may be referred by The Money Savers Network Inc. to the Subscriber/User. As a Subscriber/User to/of the website, you acknowledge that, in providing you with access to The Money Savers Network website, The Money Savers Network Inc. has relied upon your agreement to be bound by the terms and conditions of this Agreement.
